Late Night Visit and Police Bail

1. Before paying a late night visit to members of the public, officers should always consider carefully whether such visit is necessary and whether there are any better alternatives.

2. When a late night visit is really necessary, officers should ensure that the visit is justified.

3. When a decision is made to pay a justified late night visit, officers should also strike a balance between meeting operational requirements and minimising nuisance to the public.

4. A person arrested in connection with an offence may, if enquiries are not completed, be released on Police bail, but the officer in charge of the case or the Duty Officer shall ensure that every effort has been made to complete and justify the enquiries during the initial period of bail.

5. Any extensions of police bail must be authorised by an officer of the rank of Chief Inspector or above.

6. If a person on police bail reports to the police as required by the bail and there is insufficient evidence to support a charge, the person should be released unconditionally instead of having his bail extended.

7. When a person on police bail reports to the station at the appointed time, the officer receiving him shall check his identity document against the information recorded and Pol. 40 to ascertain his identity.
