The Road Traffic Legislation (Amendment) Ordinance 2008 empowers the Police to conduct Random Breath Test (RBT) to deter drink driving and introduces the use of pre-screening device (PSD) to help the Police conduct RBT operations with minimum delay to the public.

The PSD will indicate whether the proportion of alcohol in a person's breath has reached a level likely to exceed the prescribed limit.

Police General Order 64 Traffic Enforcement has been suspended and replaced by Headquarters Order No. 1 of 2009. Traffic Procedures Manual Part I Chapter 3 Drink Driving Enforcement and the related drink driving procedural forms have also been revised.

The power given to the Police to conduct RBT allows police officers to require a driver to have a breath test at any place and at any time, without the need for a reasonable suspicion.

A Drink Driving Working Group headed by Traffic Branch Headquarters and comprising representatives from Regional Traffic Formations and Police Driving and Traffic Training Division was formed in May last year. The working group will continue monitoring implementation of the new Police Power.

Existing powers to conduct screening breath test and breath test for analysis (Evidential Breath Test) remain unchanged.
